CWD's Defamatory Statement

In Mr sheahan's letter to Bluehost he made some very serious (and completely untrue) allegations against me. Mr Sheahan, on behalf of CWD, actually stated that I had committed the criminal offence of harassment.

Under the heading 'Harrassment' (sic) he stated that my invitation to give Mr Coyle an opportunity to respond to the words I intended to publish on my website was an act of harassment. Any competent solicitor practicing defamation should know that giving the right to reply before publication, far from being an act of harassment, is actually extremely important and neglecting to do so is almost always seen as aggravating the libel (where libel is proved) and would likely dramatically increase damages and/or costs.

The following is part of a ruling on defamation regarding Farrall v Kordowski by Judge Jones in which he states that ‘Kordowski aggravated the libel’ as he had ‘failed to give Farrall an opportunity to comment on the allegations before publication’. This isn't rocket science, this is simple, basic stuff.

Further, Mr Sheahan and Mr Coyle both appear to be confused as to what even constitutes defamation. In letters from Mr Coyle and Mr Sheahan they have both stated that the clear message my website gives to its readers is highly defamatory of CWD. However, the message they appear to refer to is actually a conclusion drawn by them from the facts on my website. Any competent lawyer practicing defamation will tell you that if the words published are true then they cannot be defamatory. The fact that CWD have come to various unpalatable conclusions from those facts is irrelevant.

I am staggered that Mr Sheahan and Mr Coyle do not appear to understand such simple and basic aspects of defamation, especially as CWD claim to specialise in that area! CWD partner, Mr Stephen Taylor (who actually lists defamation as one of the many areas of law he claims to specialise in), was also informed of the details on this website and given the opportunity to respond if he felt that any information on my website was untrue or inaccurate. He did not respond.

Mr Coyle's underpants

I also find it quite alarming that whilst driving, Mr Coyle spilt his coffee and nearly had an accident due to a 'young and very attractive' female driver outside a primary school. However, Mr Coyle seemed more concerned with the state of his coffee soaked underpants (presumably he was also wearing trousers) than with the fact that he could have killed or seriously injured some of the children entering the school.
