Mr Sheahan's Understanding of Malicious Falsehood

In Mr Sheahan's letter to Bluehost he stated that I had committed an act (or acts) of Malicious Falsehood. Mr Sheahan's allegation is quite obviously completely untrue and this is not the first time that Mr Sheahan has made such allegations (see also Mr Sheahan's previous threat of malicious falsehood action).

As this is now the second time (I know of) that Mr Sheahan has wrongly threatened action for Malicious Falsehood I feel it is only right that I should again point out to Mr Sheahan that for such an action to succeed in court the statements referred to must, at the very least, be false (there is a clue in the title). As all of the facts on my website are factually correct and can be proved with documentation in my possession I should imagine that CWD's threatened action will simply fail to materialise...just like last time!

Here are just some of the details of Mr sheahan's allegations:

1. According to Mr Sheahan, I claimed that CWD's failure to include a confidentiality agreement was done with the sole intention of generating further fees. Mr Sheahan is well aware that I did not make that claim, however, I do find it interesting that Mr Sheahan, having read the facts, has come to that conclusion.

2. According to Mr Sheahan, I alleged that Mr Coyle helped instigate a false harassment allegation against me. As he is well aware, I made no such allegation or inference. I even published in a bright red font the following statement from Mr Coyle: ‘Mr Coyle stated that he had nothing to do with reporting me to the police and that 'negotiations were held in good faith'’, Mr Sheahan conveniently forgot to mention this in his letter to Bluehost. Once again, I do find it interesting that Mr Sheahan, having read the facts, has come to that conclusion.

3. According to Mr Sheahan, my website claims that Mr Coyle is disingenuous. This is also untrue (ie I have not made that claim - I do not offer an opinion (publicly) on whether I believe Mr Coyle is disingenuous (or not)). I simply included a quote from Mr Coyle who stated that he had never been disingenuous in his life. At no stage have I ever made such an allegation, however, once again, I do find it interesting that Mr Sheahan, having read the facts, has come to that conclusion about his senior partner.

As Mr Sheahan is well aware, his 4 page letter is littered with false allegations and defamatory statements and was clearly contrived in order to persuade Bluehost (under threat of legal action) to remove my website from their servers. Britain has a reputation for being the libel capital of the world so it wasn't any great surprise that rather than become involved in legal action Bluehost simply asked me to find another host.
